Sufilerin şeriata (İslâm hukukuna) karşı çok az ilgilerinin olduğu veya şeriatı, insan gelişimi için ötesine geçilebilir bir hazırlık safhası olarak gördükleri, sık karşılaşılan bir söylencedir. Sufiler hukukî ve kelâmî perspektiflere tenkitçi yaklaşmakta, ancak bu ilimlerin meşruiyetini inkâr etmemekte ve sadece bu ilimleri tatbik edenlerin söz konusu ilimlerin otoritesine dair abartılı iddialarını reddetmektedirler. Sufizmin fukaha ile ilişkisini nasıl kurguladığı konusunda sunulabilecek en belirgin örneklerden biri, sufi tecrübe alanını geleneksel din bilim sistemi olan hadis, fıkıh ve kelâma dâhil etme şeklinde bir çalışma tarzına sahip olan el-Hakîm et-Tirmizî (820-30/900-910)’dir. Bu makalede onun ilmü’zzâhir ve ilmü’l-bâtın olarak adlandırdığı bilgi türleri konusundaki yaklaşımı yani hukukî ve tasavvufî bilgi arasındaki ilişkiye bakışı kısaca incelenmiştir. Ardından Ahmed et-Tîcânî (1737-8/1815) ve Ahmed b. İdrîs (1749-50/1837) tarafından kurulan Neo-Sufizm hareketlerinin iki temel yaklaşımı ele alınmıştır. Bunlar Tarîkat-ı Muhammediyye ve ictihaddır. Tarîkat-ı Muhammediyye, derunî eğitim sonrası sufinin uyanıkken Peygamber’le doğrudan görüşmesi anlamına gelir ki, bu, sufiye, sadece hayatında Peygamber’e uyduğu gerçeğini ispatlamakla kalmaz, aynı zamanda ona kurtuluşunun kesin olduğunu ve fiillerinin meşruluğunu gösterir. Diğer yandan, mezheplerin kabul edilen otoritesini eleştiren Neo-sufizme göre ictihadda bulunmak haramdır. Söz gelimi İbn İdrîs, ilmin, dolayısıyla da bütün hukukî hükümlerin (ahkâm) Kur’an ve sünnette yer aldığını söyler. Eğer bir hukukî hükmün netliği konusunda sorun varsa, kişi “Allah ve Peygamber’e” yani Kur’an ve sünnete başvurmalıdır. Şayet kutsal metinlerde geçerli bir hukukî hüküm bulamazsa, bunun nedeni o kimsenin takvasının eksikliğidir. Re’yi kullanmak, yani düşünme (fikr) ve analoji (kıyâs) yoluyla ictihadda bulunmak haramdır. Aynı şekilde ictihadı reddeden Abdülazîz ed-Debbâğ (ö. 1132/1719) şöyle der: “Aydınlanan sufinin (el-meftûh ‘aleyh) artık bir mezhebe ihtiyacı yoktur. Kendisi, bütün hukukî hükümleri onun için açıklayan Peygamber ile sürekli doğrudan irtibat halindedir. Bütün mezhepler uygulamadan kaldırılsa bile, bu daimî irtibat sayesinde şeriatı neredeyse tamamıyla yeniden canlandırmaya muktedir olacaktır.”

Ijtihãd and Neo-Sufism
It is a frequently met myth that Sufis had little concern for the Shariah (Islamic law), or that they considered it to be a preliminary stage of human development - that is a stage that one can pass beyond. Sufis are critical of the juridical and theological perspectives, however they do not deny the legitimacy of these sciences but merely refuse the exaggerated claims of authority made by their practitioners. One of the most prominent people on how Sufism conceives its relationship with fuqaha is al-Hakim al-Tirmidhi who may be described as an attempt to integrate the mystic's realm of experience into the system of traditional theology, hadith, fiqh and kalãm. In this paper, his approach to the information types he named as ilmü’z-zahir and ilmü’l-bâtın, i.e. his point of view to the relationship between the law and mystic knowledge was investigated in the briefest outline. Then, two basic approaches of Neo-Sufism founded by Ahmad al-Tijânî (1737/8 - 1815) and Ahmad b. Idrîs (1749/50 - 1837) were taken into consideration. One is tarîqa Muhammadiyya and the other is ijtihâd. Tarîqa Muhammadiyya leads the mystic to a direct encounter with the Prophet that not only proves the mystic the certainty that in his life he is imitating the Prophet, but provides him the certainty of salvation, as well as a legitimation for his actions. On the other hand, ijtihad is forbidden in Neo-Sufism that criticizes the approved authority of the madhâhib. At the outset Ibn Idrîs declares that all legal judgements (ahkâm) are contained in Qur'ân and sunna. Whenever there is lack of clarity concerning a legal judgement, one must have recourse to "God and the Prophet", i.e. Qur'ân and sunna. Consequently, if one cannot find a pertinent legal judgement in the sacred texts, the cause of this is a lack of fear of God (taqwâ). To make use of ra 'y, that is to say, the ijtihad of thought (fikr) and analogy (qiyâs) is forbidden (harâm). ‘Abd al-'Azîz ad-Dabbâgh (d. 1132/1719) refuses ijtihad in the same way and says: “The enlightened mystic (al-maftûh ‘alayhî) no longer has need of any madhhab. He is in permanent direct contact with the Prophet himself, who personally clarifies all legal decisions for him. Even if all the madhâhib were destroyed, due to this permanent contact he would be capable of virtually establishing the sharî'a all over again.”
